1000Rubs.com – Terms & Conditions

These Terms and Conditions (“Agreement”) apply to all purchases made from 1000Rubs.com, a The BBQ Store, Inc. company (“Company”). By placing an order—whether online, in-store, by phone, or at an event—you acknowledge and agree to be bound by this Agreement.

1. Binding Agreement

These Terms form a legally binding contract between you (“Customer”) and The BBQ Store, Inc. No modifications are valid unless in writing and signed by both parties.

2. Payment Terms

Payment is due at the time of purchase unless otherwise agreed in writing.
Accepted payment options include Visa, MasterCard, American Express, and Discover.

Online orders cannot request specific ship dates.

3. Shipping & Free Shipping

Shipping and handling fees are non-refundable unless expressly stated.

Free shipping applies only to orders placed through 1000Rubs.com and excludes:

  • In-store purchases
  • Orders to Alaska, Hawaii, and all international destinations

4. Receiving Your Shipment

Customers must inspect all shipments prior to signing.

  • Damage must be noted on the delivery receipt.
  • Piece count must be verified with the packing slip.
  • Once signed, the shipment becomes the property of the customer.

Any issues must be reported to the Company within 24 hours.

5. Damaged Merchandise

If visible damage exists:

  1. Note it on the freight bill and have the carrier sign it.
  2. Refuse delivery if damage is excessive.
  3. Retain all packaging.
  4. Notify the Company within 24 hours.

Failure to follow these steps may void eligibility for replacement parts.

6. Return Policy

Returns are accepted within 30 days if items are:

  • Unused
  • In original packaging
  • In resaleable condition

Returns are subject to:

  • 30% restocking fee
  • All shipping costs (initial + return)

A Return Authorization Number is required.

Non-returnable items:

  • Discontinued products
  • Dent & Scratch merchandise
  • Any item showing signs of use

7. Warranty

The BBQ Store, Inc. provides no warranties beyond the manufacturer’s warranty unless expressly stated.

If repair or replacement is required:

  • Replacement parts are shipped FedEx Ground (expedited shipping optional at customer cost).
  • Defective parts must be returned.
  • Replacement parts are billed upfront and credited after defective parts are received.

8. Enhanced Warranty Disclaimers

To the fullest extent permitted by law:

  • ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
  • The Company expressly disclaims all warranties, express or implied, including but not limited to:
  1. o Implied warranties of merchantability
  2. o Fitness for a particular purpose
  3. o Non-infringement
  4. o Any warranties arising from usage or trade practice
  • The Company does not guarantee:
  1. That products will meet your specific requirements
  2. That operation will be uninterrupted or error-free
  3. Compatibility with any third-party systems or environments

Manufacturer warranties apply only as provided by each manufacturer.

9. Limitation of Liability

To the fullest extent allowed by law:

  • The BBQ Store, Inc. is not liable for any indirect, incidental, consequential, punitive, or special damages, including:
  1. Loss of use
  2. Lost profits
  3. Lost data
  4. Personal injury
  5. Property damage
  6. Business interruption
  • The Company’s maximum liability shall never exceed the amount you paid for the product at issue.

You agree that this limitation is fundamental and forms the basis of the bargain.

10. Indemnification

You agree to indemnify and hold harmless The BBQ Store, Inc. and its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of:

  • Your misuse of any product
  • Violation of this Agreement
  • Violation of any law or third-party rights

11. Order Cancellations

Once an order is processed, it cannot be canceled.

12. Governing Law

This Agreement is governed by the laws of the State of California, without regard to its conflicts-of-law rules.

13. Product Selection & Pricing

Product availability, pricing, and selection may change at any time. Once an order is processed, no price adjustments apply.

14. Arbitration & Dispute Resolution

Before initiating arbitration, both parties agree to attempt resolution through good-faith negotiation or mediation.

If unresolved, disputes shall be resolved through binding arbitration under the CPR Rules for Non-Administered Arbitration.

Arbitration terms:

  • Venue: Bakersfield, California
  • Governed by the Federal Arbitration Act
  • Each party pays its own legal fees
  • Arbitrator’s written decision will be final and binding
  • Judgment may be entered in any court of competent jurisdiction

Confidentiality:
All negotiation, mediation, and arbitration proceedings are confidential.

Exception:
Either party may seek temporary injunctive relief from a court.

16. Copyright & Intellectual Property

You may not copy, reproduce, modify, or distribute any content without prior written permission.

17. E-Commerce Protections

To maintain order integrity:

  • Orders may be refused, canceled, or limited at any time.
  • Fraudulent or suspicious orders may be reported to authorities.
  • The Company reserves the right to require additional verification.

Confirmation emails do not constitute acceptance of your order.

18. Out-of-Stock Products

In-stock items ship promptly; out-of-stock items may cause delays.
Customers may cancel before order shipment unless otherwise restricted.

If your card has already been charged, a refund will be issued for the incorrect amount.

If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force.
